Scenario 3. Transfer of equity
William Prynne and Tracey Prynne have recently got divorced. They jointly own a property registered at HM Land Registry under title numbers ST500681. There is a mortgage (Abbey National PLC) registered on the property with a restriction preventing any disposition of the registered estate without their consent. There is also a joint proprietorship restriction on the register. As part of the divorce settlement William has agreed to relinquish his equity share in the property, the value of which is deemed £35,000. Tracey has agreed with Abbey National PLC to take sole responsibility to pay the mortgage. The conveyancer acting for Tracey submits the application to HM Land Registry. William is represented by a different conveyancer. Documents required by HM Land Registry:
- AP1 (Alteration of register)
- TR1 (Transfer)
- RX3 (Cancel a restriction)
- Statement of truth
HM Land Registry require representation details for the transferors and the transferee.
The transfer is not for value. SDLT (Stamp Duty Land Tax) evidence is not required as consideration is under the £40,000 threshold. The bank consent to release William from the mortgage terms and conditions in panel 11 of the TR1. Tracey provides a statement of truth to support the RX3 to remove the joint proprietor restriction.

This is not necessary for usual every day use but just for showing the register in the ‘before’ state.
